(no subject)

As I write my grievance to the Ontario Housing Tribunal, I become increasingly aware of how fucked my landlord is going to be when we hit court.

Congrats for the victory, condolences for the reason inspiring legal action.

Eviction notice because apparently they don't like the colour of my money.

Among other things, the contact information they provided for the head office is incorrect. Bad for them, good for me.

Be sure to mention the public statement from transglobe that they would honour all existing contracts with Minto...

Good point. I'll just add that in for icing.

What did I miss?

[identity profile] waterspyder.livejournal.com 2007-04-30 12:57 am (UTC)(link)
We got an eviction notice because they refuse to take my cheques or pre-authorized payment form and now I'm taking them to court for impairing my ability to enjoy my rental property.

[identity profile] waterspyder.livejournal.com 2007-04-30 01:53 am (UTC)(link)
I have a notice that they intend to, but they can't without a hearing. The plus side is that if they do evict us, chances are they'll end up paying the difference between what we pay now and what we'll pay in the next place.

I'd rather not move, but it's been stupid.

...what happened? Being as we share a landlord, I'm quite curious. And was whatever the problem is with our new landlord, or our old one?

[identity profile] kali-kali.livejournal.com 2007-04-30 01:04 am (UTC)(link)
*reads above* Ah, I see. That seems really... odd.

[identity profile] waterspyder.livejournal.com 2007-04-30 01:50 am (UTC)(link)
Are you guys having any problems?

[identity profile] kali-kali.livejournal.com 2007-04-30 01:52 am (UTC)(link)
Nope, we haven't had any problems.

[identity profile] waterspyder.livejournal.com 2007-04-30 01:54 am (UTC)(link)
They won't retunr my calls at any of the numbers and they won't accept cheques or the pre-authorized payment form.

[identity profile] kali-kali.livejournal.com 2007-04-30 01:55 am (UTC)(link)
Why won't they accept your cheques? And if they're not accepting your cheques or pre-authorized payment forms, how are they expecting you to pay them then?

[identity profile] waterspyder.livejournal.com 2007-04-30 11:20 am (UTC)(link)
I suspect it's because they're renting apartments in this building for over $100 more a monh than what I've been paying them and I asking for all these pesky repairs to be done.

[identity profile] kookiemaster.livejournal.com 2007-04-30 04:10 am (UTC)(link)
Sounds like they are trying to build a fake case of "tenant doesn't pay rent". It's a fairly popular tactic in Montreal. Tenant sends in cheques, landlord doesn't cash them, tenant doesn't notice and then landlord pretends he never got the cheques in the first place and says the tenant is not paying rent. They usually do that when they want to get rid of a tenant so they can rent it at a much higher price and they know full well that they wouldn't be able to get away with a crazy rent hike with zero improvements to the unit.

[identity profile] waterspyder.livejournal.com 2007-04-30 11:22 am (UTC)(link)
That's my theory! And most of my neighbours barely speak passable English or French and probably don't know their legal rights.

I just happen to record my dates when I call and visit.

The fact that they won't return my calls is just lame.

[identity profile] kookiemaster.livejournal.com 2007-04-30 12:48 pm (UTC)(link)
You can always send your cheques through registered mail WITH signature. When Minto was being a pain and not returning my letters and such because I was trying to move out, that's what I did: registered mail at headquarters ... putting in the letter that a cc was going to the OHT. Got a phonecall the same day. Sure it costs quite a bit but it sends the message "I mean business and you can't ignore me anymore" quite clearly.

[identity profile] waterspyder.livejournal.com 2007-04-30 05:55 pm (UTC)(link)
cc to OHT... nice work

[identity profile] ironphoenix.livejournal.com 2007-04-30 02:24 am (UTC)(link)
Best of luck... hopefully, this will convince them that you're not to be lightly irked.

Thats right, kick 'em to the curb sweetie!
